Terms of Service

1. Acceptance of Terms
By accessing or using the Artic platform, website, APIs, or any related services (collectively, the “Service”) provided by Artic Technologies Pvt. Ltd. (“Artic”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must discontinue use of the Service immediately.
These Terms constitute a legally binding agreement between you (either an individual or the entity you represent) and Artic. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
2. Description of Service
Artic provides a cloud-based voice-AI platform that combines telephony infrastructure, automatic speech recognition (ASR), large-language-model (LLM) reasoning, and text-to-speech (TTS) synthesis into a single pay-per-minute pipeline. The Service is designed for Indian SMBs, enterprises, and developers building automated voice experiences across Indian languages.
Artic reserves the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable prior notice where practicable. Feature previews and beta offerings are provided as-is and may be changed without notice.
3. Accounts & Eligibility
To access the Service you must register for an account. You must be at least 18 years of age and capable of entering a binding contract under applicable Indian law. Accounts registered on behalf of an entity require a duly authorised representative.
You are responsible for:
- Maintaining the confidentiality of your credentials.
- All activity that occurs under your account.
- Notifying Artic promptly at security@artic.ai of any unauthorised access.
Artic may suspend or terminate accounts that violate these Terms or that show signs of fraudulent activity.
4. Acceptable Use
You agree not to use the Service to:
- Transmit unsolicited commercial communications (spam) or conduct robocalling campaigns without recipient consent in violation of TRAI regulations or the Consumer Protection Act, 2019.
- Impersonate any person, government entity, or organisation without lawful authorisation.
- Process or store sensitive personal data (including Aadhaar numbers, financial credentials) via the Service without appropriate safeguards under applicable law.
- Reverse-engineer, decompile, or attempt to extract source code from the Service.
- Interfere with or disrupt the integrity, performance, or security of the Service or its underlying infrastructure.
- Facilitate any activity that is unlawful under the laws of India or any applicable jurisdiction.
Artic may monitor usage to detect violations and reserves the right to refuse service, throttle usage, or terminate accounts that breach this policy without refund.
5. Billing, Wallet & Refunds
The Service operates on a prepaid wallet model. You must maintain a positive wallet balance to originate calls. Usage is billed per active call-minute at the rate applicable to your plan tier at the time of the call. Rates are displayed in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise.
Wallet top-ups are non-refundable except where required by applicable law or in the case of a verified billing error. To dispute a charge, contact billing@artic.ai within 30 days of the transaction date with full details.
Artic reserves the right to adjust pricing with 30 days’ notice to registered account holders. Continued use after the effective date constitutes acceptance of the revised rates.
6. Intellectual Property
All software, models, brand assets, documentation, and other materials comprising the Service are the exclusive property of Artic Technologies Pvt. Ltd. or its licensors and are protected by Indian copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, Artic grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for its intended purpose. No rights are granted by implication or estoppel.
You retain ownership of any content or data you submit to the Service (“Customer Data”). You grant Artic a limited licence to process Customer Data as necessary to provide and improve the Service, subject to our Privacy Policy.
7. Limitation of Liability
To the maximum extent permitted under applicable Indian law, Artic and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of or inability to use the Service.
Artic’s total cumulative liability arising out of or relating to these Terms shall not exceed the amount paid by you to Artic in the three (3) calendar months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded under Indian law.
8. Termination
Either party may terminate these Terms at any time. You may close your account by contacting support@artic.ai. Artic may terminate or suspend your access immediately if you breach these Terms or if required to do so by applicable law or a competent authority.
Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) shall so survive. Unused wallet balance remaining upon account closure will be refunded within 30 business days, subject to verification, unless otherwise required by law.
9. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.
Before initiating legal proceedings, both parties agree to attempt in good faith to resolve any dispute through negotiation for a period of not less than 30 days.
10. Miscellaneous
Entire agreement. These Terms, together with our Privacy Policy and any order forms or API agreements, constitute the entire agreement between you and Artic regarding the Service.
Severability. If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force.
Waiver. Failure to enforce any right or provision of these Terms shall not constitute a waiver of that right.
